“We” are:    

Jo Adams trading as Hair & Make Up Atelier of 7 Sneezum Walk, Witham, Essex, CM81US.

 

(“The Hair & Make Up Artist”)

“You” are:

         

The customer or customers that received the proposal (where more than one person, they shall be jointly and severally liable).

(“The Client”)

 

1.    Definitions

 

In this agreement:

“The Assignment”    means the project of work, goods and services set out in the proposal. It includes the Design Appointment and the delivery of goods and services at the Event.

“The Event”    means the event where the Assignment is to be delivered by The Hair & Make Up Artist.

 

2.    Price and payment

 

2.1.    Price for the Assignment is set out in the quotation (“the Price”) There is no VAT.

2.1.1    Prices charged are per booking, and any additional services for additional family or friends added to the Assignment shall attract further fees. 

2.1.2    The Price includes the delivery of makeup and/or hair styling services, and all ancillary services to complete the Assignment.

2.1.3    The Price excludes any expenses that will be incurred by the Hair & Make Up Artist, unless otherwise agreed in writing by the parties. The Price also excludes any travel expenses to the Event which is charged at 45p per mile from the Hair & Make Up Artist’s base and return, less 30 free miles.

2.2.    A Retainer Payment (“the Retainer”) of 50% of the Price shall be paid upon entering this agreement. The Retainer is to cover the costs of the initial Design Appointment and to secure the date for the delivery of the Assignment and the preparation time required. The Hair & Make Up Artist’s invoice for the Retainer will follow – please refer carefully to Clause 3. 

2.3         The Price and the Retainer shall be the Fees of the Hair & Make Up Artist.  

     The Client shall pay the Hair & Make Up Artist the balance of the Fees and    artists travel costs (the Price less the Retainer) at the latest 14 days before the Event and all Fees shall be paid in advance in full.

 

 

3.    Cancellation of agreement and the Retainer

3.1.    Once the Retainer has been paid, the Assignment can be cancelled by either party in writing or by email subject to the matters set out in this clause. 

3.2    If the Hair & Make Up Artist cancels the Assignment, the Fees paid at the time of cancellation will be repaid to the Client within 14 days of cancellation and no further sum or compensation will payable to the Client by the Hair & Make Up Artist arising from such cancellation.

3.3    Client cancellation

    3.3.1    If the Client cancels the Assignment within 14 days of entering into this agreement, then the Retainer shall be repaid to the Client in full.

3.3.2     If the Client seeks to cancel this Assignment 14 days after entering this agreement but more than 14 days before the Event then the Retainer shall be forfeited, any expenses incurred as at the date of cancellation must be paid by the Client, and those paid shall also be non-refundable. No further sums will be due from the Client to the Hair & Make Up Artist.

3.3.3    If the Client cancels this Assignment within 14 days or less of the Event, then the Fees in full plus any expenses incurred as at the date of cancellation (less any monies paid) shall be due to the Hair & Make Up Artist.

 

4. The Assignment.

4.1    The Hair & Make Up Artist reserves the right to use images of her work during the Assignment for marketing, promotional, competition and editorial purposes. If you do not wish to give consent to this use of the work or your image, then you must confirm this by email within 14 days of entering into this agreement.

4.2    Trial sessions

    4.2.1    All trial sessions last about 2-4 hours and are held at

a location agreed by the Client and the Hair & Make Up Artist

    4.2.2    Trials should be attended by the Bride and ONLY one other person. No children under 18 years old are allowed to attend the trial unless agreed otherwise in writing.

4.2.3    Trials are recommended to be undertaken at least 3 months before the Event. They usually need to be booked in advance about 6 months before the Event.

4.3    Date changes to the Event must be submitted in writing and the new date is subject to availability. If the new date cannot be accommodated by the Hair & Make Up Artist, this will constitute a cancellation and clause 3 will apply 

4.4    Final numbers receiving the services at the Event must be received in writing from the Client by the Hair & Make Up Artist at least 14 days before the Event. If numbers subsequently increase, the Hair & Make Up Artist reserves the right to increase their Price accordingly. If numbers subsequently decrease, there will be no discount and the Price shall be charged in full.

4.5    The Hair & Make Up Artist reserves the right to refuse services to the Client, or any connected person, if they show symptoms of any infectious condition, or use, or threaten, abusive or inappropriate behaviour.

4.6    The Hair & Make Up Artist reserves the right to use the additional services and assistance of other make up artist’s or hairdressers, if it is necessary to deliver the Assignment.

 

 

5.    Allergies

5.1    The Hair & Make Up Artist will not be held responsible for any allergies or reactions caused by our goods. 

5.2    It is the Client’s responsibility to inform the Hair & Make Up Artist in writing of any sensitivities/allergies/intolerances at the time of booking or at the latest 14 days before the Event. The Hair & Make Up Artist cannot accept any liability for allergies or reactions where they have not been advised of such risks. 

6.    General Conditions

6.1    Verbal or email instructions by the Client to proceed will constitue an acceptance in full of these terms and conditions.

6.2    The Fees will be paid after invoices rendered from time to time. No VAT is applicable. Payment terms are 7 days, and payment is not deemed to have been made until the Fees have been paid in full. If payment is not made in full and within time the services may be suspended and payment in advance may be required before the services are re - commenced.

6.3    The Hair & Make Up Artist reserves the right to require some or all of the  Fees to be paid in advance of the commencement of the services where applicable and agreed in writing. If payment is not made in accordance with the above clauses, the Hair & Make Up Artist reserves the right to charge an administration fee of £50 to late payments together with interest at the rate prescribed by the Late Payment of Commercial Debt (Interest) Act 1998 from the date payment was due until the date payment is made.

6.4     Each party will keep the confidential information of the other party and any third party confidential and secret, and only use it for the purposes of supplying the services or making proper use of the services. Each party recognises and accepts its obligations with regard to the control and the processing of personal data under the current data protection legislation and regulations. 6.5    The Hair & Make Up Artist will use reasonable care and skill in performing the services. 

6.6    The Hair & Make Up Artist's liability in respect of any loss of good will, loss of business, loss of profits, loss of anticipated savings, loss of use or for any other consequential, special or indirect loss or damage will be NIL. 

6.7    In respect of any other direct losses (in Contract or Tort) the total liability of the Hair & Make Up Artist will not exceed the return of all payments received, and thus the limit of liability shall not exceed the value of the services provided.

6.8    Nothing in these Terms will exclude or limit liability for death or serious injury caused by the Hair & Make Up Artist's negligence.

6.9    The services may be terminated if payment of the Fees is not made in accordance with these terms, or if the Client commits a material breach of any of these terms and fails to remedy the breach within 14 days of being notified in writing, or if the Client enters into any form of insolvency arrangement. Upon termination the Client shall immediately pay any outstanding sums to the Hair & Make Up Artist. 

6.10    The Hair & Make Up Artist shall not be liable for any breach of contract due to force majeure.

6.11    Nothing in these terms are intended to create a partnership or joint venture between The Hair & Make Up Artist and the Client, and no party has the right to act as agent for the other or to bind the other party in any way.

6.12    These terms and any dispute arising from them shall be governed by the laws of England and Wales.

FURTHER BOOKING INFORMATION 

BOOKING – OTHER MAKEUP/HAIR/LESSONS

Bookings are secured upon email confirmation from The Company. This confirms the Agreement and secures the Company’s availability for the Event on the agreed date and time for the agreed Fee.

The full cost of a booking is incurred if a cancellation is received less than 24 hours before the Event.

Cancellations are only deemed valid if received via email.

The Fee is always agreed via email, verbal agreements are not offered as they are not deemed valid by the Company.

The Company reserves the right to cancel special offers and rates at any time, with the exception of where an emailed Agreement is already in place with the Client.

 

TRAVEL EXPENSES FOR BOOKINGS WITHIN THE MAINLAND UK

For Jo : travel expenses are incurred for services booked outside a 15-mile road distance from CM8. They are at a rate of 45p for every mile outside the 15 mile road distance from the Studio and are based on a return journey.

For other team members: travel expenses are incurred for services booked outside a 15-mile road distance from their home address. They are at a rate of 45p for every mile outside the 15-mile road distance from their home address and are based on a return journey. The particular cost for your artist will be calculated at the point of enquiry. 

Where travel expenses are incurred for travel by car to locations where the service is to be provided, please note that parking charges with be added to the your invoice. 

Distances are calculated using an online journey planner and travel expenses will be agreed between the Company and Client as part of the Agreement.

If required, alternative methods of transport other than motor vehicles, such as rail or flight will be discussed and agreed with the Client during the booking process.

 

TRAVEL EXPENSES FOR BOOKINGS OUTSIDE OF THE MAINLAND UK

Travel expenses are incurred for services booked outside of the mainland UK, they are as follows:

  • Travel expenses to and/or parking at a train station, airport or port where the Team member(s) will be travelling from. If the journey to the train station, airport or port is by car then 45p for every mile outside of a 15-mile road distance from CM8 is charged for Jo and all Team members home addresses. 

  • Return rail tickets, flights and/or boat tickets for all Team member(s) booked from/to convenient train stations, airports and/or ports. The Company will always endeavour to find the most cost-effective option; and

  • All additional travel required at the destination related to provision of services at the Event.

Road distances are calculated using an online journey planner and travel expenses will be agreed between the Company and Client as part of the Agreement.

A minimum booking fee will apply for Jo and for each team member for international bookings. This will be discussed and outlined at the point of enquiry. 

ACCOMMODATION & SUBSISTENCE EXPENSES FOR BOOKINGS WITHIN THE MAINLAND UK

For Jo and any member of the Atelier Team accommodation expenses are incurred for services provided within the mainland UK for bookings that are to start prior to 7am at a location over 50 miles road distance from the CM8 or the Team members home address. This will be discussed and agreed with the Client during the booking process.

ACCOMMODATION & SUBSISTENCE EXPENSES FOR BOOKINGS OUTSIDE OF THE MAINLAND UK

For bookings outside of the mainland UK accommodation expenses within the mainland UK will be charged for trains, flights or boats leaving the mainland UK. 

Additional accommodation expenses at the destination of the Event may also be incurred however all accommodation expenses will be discussed and agreed with the Client during the booking process.

£25 will be charged for subsistence per Atelier Team member for every 24 hours spent away from home for a booking.

The Company will always endeavour to find the most cost-effective option.

PAYMENT – HAIR/MAKEUP

An invoice for the balance of the Fee will be sent from the Company to the Client at least 3 weeks before the date of the Event, unless the Event is in less than 3 weeks’ time in which case it will be sent immediately after the booking has been secured.

Full payment of the balance of the Fee is required 2 weeks before the Event at the latest, if the Event is less than 1 week away full payment is required to secure the booking. There are no exceptions to this.

Payment can be accepted via bank transfer or PayPal.

Bookings are only confirmed once the funds have cleared in the Company’s bank account.

CLIENT RESPONSIBILITY

It is the Client’s responsibility to inform the Company or Team member who is engaged to provide the service of any potential issues such as but not limited to medical conditions, allergies, and/or sensitivities. Neither the Company nor Team member can be held liable for any condition that arises or loss incurred by the Client if the Client has not informed the Company and/or Team member of any known conditions as stated above, or of any conditions unknown to the Client at the time of the service. 

 

The Company and/or Team member reserve the right to cancel the Agreement if the behaviour of the Client is deemed inappropriate and/or if the Client reports a condition that the Company and/or Team member deem as a risk to the Client’s health and well-being. In these cases any payments that have already been made by the Client for the service are non-refundable.

COMPANY RESPONSIBILITY

The Company will always endeavour to honour the Agreement to the best of its ability.

 

There may be circumstances beyond the control of the Company where a Team member is unwell, delayed or otherwise unavailable, sometimes at short notice. In such a case the Company will inform the Client at its earliest convenience and endeavour to make favourable alternative arrangements if possible.

The Company reserves the right to offer the Client compensation in the event that it is not able to honour the Agreement. This is entirely dependent on the circumstances and will be discussed openly and honestly with the Client.

CANCELLATIONS

Unless specified differently on the webpage for the service:

- If a booking is cancelled for any reason except for an event of Force Majeure the amount payable to the Atelier under this agreement shall be determined as follows:

6 – 4 weeks prior to the engagement – 50% of the agreed fee.

3 – 2 weeks prior to the engagement – 75% of the agreed fee.

2 weeks - On the day prior to the engagement –100% of the agreed fee.

All seven days of the week count for the notice period.

For the purpose of calculating the number of days notice given, the day on which notice is given is included but the event day is not. 

If the period of engagement is three days or less, the cancellation fee applies to the whole engagement. If the period of engagement is more than three days, then each day is a separate engagement and the cancellation fee is calculated for each day.

cancellations by the Client for a non-wedding service where a payment has been made, that are received less than 3 weeks before the start of the service are non-refundable. Cancellations received before this time will be refunded in full within 7 days of the cancellation.

Cancellations for services booked where travel and/or accommodation expenses have been paid for by the Company and are non-refundable by the travel/accommodation provider(s) will incur full reimbursement from the Client to the Company for the travel and/or accommodation costs paid.

PHOTOGRAPHY & USE OF IMAGES

Photographic/video images of the Client, Party and/or Event will not be used by the Company in promotional material unless the Client’s express permission has been granted.

CHANGES TO SERVICES AND PRICES

Prices for products and services are subject to change without notice.

The Company reserves the right to modify or discontinue a service (or any part or content thereof) at any time without notice.

ADDITIONAL IMPORTANT DETAILS

Maximum time allocation for Design Appointments: the maximum time that the Team can spend on any one trial is 2.5 hours for a makeup or hair booking or 4.5 hours for a makeup and hair booking. Any additional time required for trial sessions will have to be booked as a repeat trial.

Repeat trials: If a second makeup and/or hair trial are requested the same fee applies as for the first trial.

Additional members of the Atelier Team at Jo’s bookings: Team members will only be present if there is a time constraint and it is not possible for her to provide the hair and makeup for the Party within the agreed time.

Additional Artist Fees: Examples of where additional artist fees will be applied are : If the start time for a booking is amended to be later than in the initial Agreement, however the finish time is to remain the same; or if a booking is requested for one Atelier Team member but is deemed by the Company not to be possible for one person due to time constraints; or a venue has a set access time that would limit the artists capabilities, the Party wish to have a later start for hair and make up; the ceremony time is before 11.30am. 

Individual lashes: individual lash application is included in the price for the makeup service, there is no reduction in price for any makeup service if they are declined.

Makeup and Hairstyling  services for younger members of the Party: makeup services for members of the Party who are up to 12 years old are discounted to Junior Bridesmaid prices. This will only include lip gloss, blusher, and shimmery eyeshadow application.

If a more complete hair or makeup service is required the full bridesmaid’s price will apply.

Hairstyling services for members of the Party who are up to 12 years old are charged at Junior Bridesmaids prices. Examples of this will only include plaits or loose waves with a plait – up to 15 minutes of hairstyling per Party member.
